Welcome to PNCS LLC®, our web site, services and information are subject to the following Terms of Use. By using the PNCS® web site or services you agree to be bound by the following Terms of Use terms and conditions. PNCS LLC® reserves the right to alter, modify or in any way change the Terms of Use and the terms and conditions thereof at any time as seen fit by PNCS® management.

PNCS® Services
PNCS® offers several coin grading services for both collectors and dealers. Coin grading is subjective, any and all coins certified by PNCS® will be graded according to the opinion of PNCS® regarding the coins condition and quality. PNCS® will in no way guarantee that any coin certified by PNCS® will receive the same certification grade if sent to another company for grading. PNCS® reserves the right to change, alter or in any way modify our fee structure for any and all services as seen fit by PNCS LLC® management. Any and all services, features or modifications to the PNCS® web site or line of services will be bound by the terms and conditions of Terms of Use.

Turn-Around Policy
PNCS LLC® strives to handle any and all submissions in a timely manner with a turn around time goal of (10) ten business days from the date that the submissions arrive at the PNCS LLC® submission office.  This turn-around time is strictly a guide for our users and may not reflect the actual turn-around time of any submission. Turn-around times will vary.

Informational Purposes Only
PNCS® will in no way be held responsible or liable for the accuracy, usefulness, completeness or availability of any and all content, including but not limited to, graphics, editorials, advertisements, advice, contact information or other material either transmitted or made available by the PNCS® web site, nor shall PNCS® be held liable for any decision made in reliance of these materials. Any and all financial or investment information provided by PNCS®, by any means, is strictly for informational purposes and is not intended to be used as investment advice. You assume all investment and or financial risk for any investment, trading or other decisions you make based on this information and will not hold PNCS LLC® responsible for any profit and or loss incurred on you behalf. PNCS® may provide links to web sites or resources outside of the site, due to the fact that PNCS® has no control over these sites, or the resources they may offer, you acknowledge and agree that PNCS® will in no way be held liable for the availability of such sites or resources and does not endorse and is not liable for any and all content, advertising, goods, services, or other materials on, available through or provided by such sites or resources. Any and all correspondence or business transactions with, or participation in promotions of, any web sites that you find or link through the PNCS® site, including payment and delivery of related goods, or services, and any other terms, conditions, warranties or representations associated with such transactions, are solely between you and such web sites. You agree that PNCS® shall not be responsible or liable for any loss and or damages as the result of the presence of links to such websites and or services.

Sale of Coins
PNCS LLC® in no way participates in the sale of coins. PNCS® is strictly a grading company and while we may offer services and or material related to coins such as, but not limited to, that of grading, supplies and books PNCS® will in no way be involved in any transaction for the buying or selling of any coin.

Sale of Services
All products, services or other fees which may apply to your submission must be paid in full before any coin will be certified. This includes, but is not limited to, shipping expenses, submission fees, personalization fees and any other fee for which payment is due. All sales, including but not limited to, those of submission services, supplies, advertising or products are final. We will not be able to cancel or change any order for any reason once it has been received. We do not accept returns on products or services and all purchases are non-refundable.

Submissions
Any information, graphics, comments, ideas or other materials submitted by you to PNCS® through the site may be used or published by PNCS® for any purpose, in any form, through any media, throughout the world perpetuity and without restriction, without compensation or attribution to you being do.

Termination of Use
PNCS LLC® reserves the right, in its sole discretion, to termination and or suspend service to anyone for any reason including, but not limited to, a breach of the Terms of Use and or conduct by you that PNCS® finds to be inappropriate.

Loss or Damage
By using the PNCS® site and or services you agree that PNCS® will in no way be held responsible or liable for any and all loss, damage, theft or other financial loss incurred on your behalf including, but not limited to, that of loss of coins, damage to coins, either while in transit or while in the possession of PNCS®.

Intellectual Property
You acknowledge and agree that any and all information on the site, including but not limited to, that of editorials, trademarks, copyrights, service marks, patents, software and any other proprietary and/or confidential information is the sole property of PNCS LLC®. Except as expressly authorized in writing by PNCS LLC® you agree not to modify, rent, lease, loan, sell or distribute, in part or in whole, any content belonging to PNCS LLC®.

Indemnification
You hereby agree to defend, indemnify and hold harmless PNCS LLC® and its partners and associates from any and all claims, disputes, demands, suits, liabilities and damages of every kind arising for any reason, including but not limited to, your failure to comply with your representations and warranties contained in the Terms of Use or any other terms and conditions included in the Terms of Use, or your violation of any law or the rights of any third party.

Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

YOUR USE OF THE PNCS LLC® WEBSITE AND ITS SERVICES IS AT YOUR SOLE RISK. THE PNCS LLC® WEB SITE AND SERVICES AND ALL CONTENT CONTAINED THEREIN IS PROVIDED ON AN "AS IS"  AND "AS AVAILABLE"  BASIS. PNCS LLC® EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, AS TO THE OPERATION OF THE SITE, CONTENT, INFORMATION, SERVICES OR PRODUCTS INCLUDED OR OFFERED ON OR THROUGH THE SITE, INCLUDING BUT NOT LIMITED TO, THE IMPLIED MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

PNCS LLC® MAKES NO WARRANTY THAT (i) THE PNCS LLC® PRODUCTS OR ANY OTHER PORTION OF THE SERVICES IT OFFERS WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF ANY PNCS LLC® PRODUCTS OR ANY OTHER PORTION OF THE SERVICES WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY SERVICES OR INFORMATION OBTAINED BY YOU THROUGH PNCS LLC® WILL MEET YOUR EXPECTATION, AND (v) ANY ERRORS IN THE SITE WILL BE CORRECTED.

THE SERVICES OF PNCS LLC® THAT ARE OPINIONS OF VALUE AND/OR CONDITION ARE STRICTLY INFORMATIONAL AND SHOULD NOT BE RELIED UPON FOR INVESTMENT ADVICE.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT PNCS LLC® SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF PNCS LLC® HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OF, OR INABILITY TO USE, ANY PNCS LLC® PRODUCT OR SERVICE; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOU TRANSMISSION OR DATA; (iii) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE; OR (iv) ANY OTHER MATERIAL RELATING TO PNCS LLC®'S SERVICES OR SITE.

Other Information

You agree that any legal proceedings taken against PNCS LLC®, its employees, agents, owners, or associates in reference to any product or service purchased for any reason shall be filed in the District Court of Cleveland County, Oklahoma, and the party filing such legal proceeding will be liable for any and all legal fees and cost incurred by PNCS LLC®, its employees, agents, owners or associates in defending such action, whether the same is dismissed or not by said party and regardless of the outcome of any such legal proceeding. The failure of PNCS® to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. You agree that regardless of any statute of law to the contrary, any claim or cause of action arising out of or related to PNCS LLC® services, products or the Terms of Use must be filed within (6) months after such claim or cause for action arose or be forever barred.
